Finio, Inc. Privacy Policy

Finio, Inc. (“Finio”, “we”, or “us”) provides technological solutions designed to ease the credit application and decisioning process. Protecting your privacy is important to us. This Privacy Policy explains how we collect, use, and share your personal information and is intended to help you understand and exercise your privacy rights.

This Privacy Policy applies to personal information processed by us, including on our websites and other online and offline offerings (collectively, “Services”). On third-party websites, including our dealer, retailer, and marketplace customer websites, the privacy statement or policy of the third party applies, even if those third-party websites integrate the Services. This Privacy Policy applies only to information directly submitted to or collected by the Services. This Privacy Policy does not govern the information practices or the content of any other websites or where the Services contain links to other websites. We encourage you to review the privacy statements of other websites to understand their information practices.

By using our Services, you hereby consent to our Privacy Policy and agree to its terms.

Personal Information We Collect

The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information.

If you contact us directly, we may receive additional information about you such as your name, email address, phone number, the contents of the message and/or attachments you may send us, and any other information you may choose to provide.

When you register for an account, we may ask for your contact information, including items such as name, company name, address, email address, and telephone number.

If you are a Finio customer, which may include dealers, retailers, marketplaces, and our financing partners (collectively, “Finio Customers”), we may collect and receive information pertaining to your customers and billing details (e.g., credit card information, billing address).

If you are an employee, authorized user, or other individual who is granted access to our Service by a Finio Customer (collectively, “Authorized Users”), we may collect your email address, phone number, password and similar account details and information.

If you are a user of the Services, which includes consumers who are applying for financing (“End Users”), we may request, and you may provide personal information in connection with your application. Such personal information may include your name, address and residence history, employment information and employment history, phone number, financial credit data, driver’s license number and email address.

How We Use Your Information

We use the information we collect in various ways, including to:

  • Provide, operate, and maintain our Service;
  • Improve, personalize, and expand our Service;
  • Understand and analyze how you use our Service;
  • Develop new products, services, features, and functionality;
  • Communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the website, and for marketing and promotional purposes;
  • Send you emails; or
  • Find and prevent fraud.

If you are a Finio Customer, we may use personal information to fulfill our obligations to you or to perform the services you request. We may also use personal information to carry out our core business operations and to perform functions such as billing and reconciliation and meet our contractual and legal obligations.

If you are an Authorized User, we may use personal information in connection with providing the Services to a Finio Customer. This may include using your personal information to create, update, and maintain your account with Finio.

If you are an End User, we may use your personal information in connection with or to facilitate a purchase, lease, or financing transaction. Further, we may share your personal information with our service providers, vendors, and other third parties in connection with the transaction and the evaluation of your finance or lease application. This may include your name, email address, date of birth, phone number, employment and income details, social security number and other data from your credit bureau file.

Additionally, we may use and share your personal information for other business purposes, which may include:

  • With our service providers, partners, or contractors, including data processors, in connection with the services they perform for us;
  • To enforce a contract with you;
  • To comply with applicable law or regulation, or a judicial proceeding, court order, or legal process;
  • To ensure the quality of information;
  • In connection with a change of ownership or control of all or part of our business;
  • As we reasonably believe is appropriate to protect the rights, privacy, or property of you, Finio, our partners, and others; or
  • For any other purpose with your consent.

We may collect, use, and share your information in an aggregated, deidentified or anonymized form, which will not identify you personally, for any purpose permitted under applicable law. This may include creating or using aggregated, de-identified, or anonymized data to improve or develop products and services.

Cookies and Web Beacons

Like many website owners and operators, we use automated data collection tools such as Cookies and Web Beacons to collect certain information.

“Cookies” are small text files that are placed on your device by a web server when you access our Services. We may use both session Cookies and persistent Cookies to identify that you have logged in to the Services and to tell us how and when you interact with our Services. We may also use Cookies to monitor aggregate usage and web traffic routing on our Services, to customize and improve our Services, and geocode your IP address to better serve location-based information. The following Cookies are used to handle current user authentication session, redirection URL, and store Cross-Site Request Forgery (CSRF) token:

Unlike persistent Cookies, session Cookies are deleted when you log off from the Services. Although most browsers automatically accept Cookies, you can change your browser options to stop automatically accepting Cookies or to prompt you before accepting Cookies. Please note, however, that if you do not accept Cookies, you may not be able to access all portions or features of the Services. Some third-party website providers that we may engage may also place their own Cookies on your device. Note that this Privacy Policy covers only our use of Cookies and does not include use of Cookies by such third parties.

“Web Beacons” (also know as Web bugs, pixel tags or clear GIFs) are tiny graphics with a unique identifier that may be included on our Services for several purposes, including to deliver or communicate with Cookies, to track and measure the performance of our Services, and to monitor how many visitors view or use our Services. Unlike Cookies, which are stored on the user’s device, Web Beacons are typically embedded visibly on web pages. We may also include Web beacons in emails to understand whether messages have been opened, acted upon, or forwarded.

Log Files

Our servers automatically record certain information about how a person uses our Services (“Log Data”). Log Data may include information such as a user’s Internet Protocol (IP) address, browser type, operating system, the web page that a user was visiting before accessing our Services, the pages or features of our Services to which a user browsed and the time spent on those pages or features, search terms, referrer headers/referrer URLs, the links on our Services that a user clicked on and other statistics. We use Log Data to administer the Services and we analyze (and may engage third parties to analyze) Log Data to improve, customize, and enhance our Services by expanding features and functionality, and tailoring them to our users’ needs and preferences. We may also use a person’s IP address to generate aggregate, non-identifying information about how our Services are used.

Do Not Track Signals

Our Services do not have the capability to respond to “Do Not Track” signals received from various web browsers.

Storage and Retention of Personal Information

We retain personal information for no longer than necessary to fulfill the purposes for which it was collected and used in accordance with our agreements with Finio Customers, as applicable, as described in the policy, unless a longer retention period is required or permitted under applicable law. We also retain personal information we receive from you as a result of your use of our Services for as long as necessary to resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.

Security

We take reasonable administrative, physical, and electronic measures designed to protect the information that we collect from or about you from unauthorized access, use, or disclosure. Please be aware, however, that no method of transmitting information over the Internet or storing information is completely secure. Accordingly, we cannot guarantee the absolute security of any information.

By using our Services or providing personal information to us, you agree that we communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our Services, by mail, or by sending an email to you.

Notice for California Residents

The California Consumer Privacy Act of 2018 (“CCPA”) provides California residents with the right to know what categories of personal information we have collected about them and whether we have disclosed that personal information for a business purpose in the preceding 12 months.

Under applicable law, and subject to limitations and exceptions provided by law, if you are a California resident, you may have the following rights with respect to information we have collected or received about you that constitutes personal information under the CCPA:

  • To request access to more details about the categories and specific pieces of personal information we may have collected about you in the last 12 months (including personal information disclosed for business purposes);
  • To request deletion of your personal information;
  • To opt-out of any “sales” of your personal information, if a business is selling your information; and
  • To not be discriminated against for exercising these rights.

To exercise your access or deletion rights, where applicable, you can submit a request to: support@finio.com. You may be required to provide additional information necessary to verify your identity before we can respond to your request.

We will consider all such requests and provide our response within a reasonable time (and within any time period required by applicable law). Please note, however, that certain information may be exempt from such requests, for example, if we need to keep the information to comply with our own legal obligations or to establish, exercise, or defend legal claims.

Please note that if you are an End User, we may contact the relevant Finio Customer that collected your personal information to process your request.

Children’s Information

The Services are not directed to children under 13 (or other age as required by local law), and we do not knowingly collect personal information from children. If we become aware that a child has provided us with personal information in violation of applicable law, we will delete any personal information we have collected, unless we have a legal obligation to keep it, and terminate the child’s account, if applicable.

Changes to our Privacy Policy

We may revise this Privacy Policy from time to time in our sole discretion. If there are any material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to use our Services after the new Privacy Policy takes effect.
